1. Terms of Service:

1.1 Nature of Service: Administrative Literacy & Clerical Support
Divorce Recovery provides administrative literacy support. We assist self-represented litigants who require clerical help with the physical organization of data and the transcription of information into standardized court forms (J101E/J107E). We are not attorneys, advocates, or legal practitioners. We do not provide legal strategy or representation.
 
1.2 The "Final Author" & Mandatory Verification Rule
· Client Autonomy: Every document produced (including Parenting Plans, Maintenance Applications, and Protection Orders) is created strictly using the data, narratives, and evidence provided by the client.
· Mandatory Audit: The client is the "Final Auditor" and "Author." You are legally required to review, verify, and approve every word and number before submission.
· Adoption of Work: By signing or serving a document prepared by us, you explicitly adopt that document as your own work and confirm it is 100% accurate.
 
1.3 Absolute Indemnity & Limitation of Liability
· No-Sue Agreement: By using this service, the client waives the right to sue Divorce Recovery for any court outcome, cost order or legal failure.
· Indemnification: You agree to indemnify Divorce Recovery against any legal action or costs arising from a client’s decision to provide inaccurate information or serve unverified documents. You agree to pay for our legal costs if we are sued by you or a third party (like an ex-spouse's attorney) because of information you told us to put in your documents.
· Procedural Risks: Divorce Recovery is not liable for "adverse outcomes" if you ignore procedural guidance or provide unverified evidence.
 
2. Privacy Policy:
2.1 Data Processing for Maintenance & Support
We process "Special Personal Information" solely to perform clerical duties, including:
· Financial Data: Analysing bank statements and budgets for Maintenance calculations.
· Sensitive Evidence: Organizing photos, messages, or statements for Protection Orders and Portfolios of Evidence.
 
2.2 Data Destruction
To protect your privacy, Divorce Recovery reserves the right to delete all sensitive digital files and bank statements 30 days after the service is finalized.
 
2.3 Data Security & Breach Limitation of Liability

· Security Measures: Divorce Recovery implements reasonable technical and organizational measures to secure the integrity and confidentiality of your "Special Personal Information" in accordance with POPIA. This includes secure digital storage and restricted access to sensitive folders.
· Third-Party Platforms: The client acknowledges that data is uploaded via third-party digital platforms (e.g., cloud storage/email). While we use reputable providers, Divorce Recovery does not control these platforms' absolute security.
· Limitation of Liability for Hacks: In the event of a sophisticated cyber-attack, data breach, or "hack" that occurs despite our reasonable security efforts, the client agrees that Divorce Recovery shall not be held liable for any resulting damages, provided we have complied with the mandatory breach notification requirements set out in Section 22 of POPIA.
· Client Responsibility: You are responsible for securing your own login credentials and ensuring that the devices you use to upload documents to us are free from malware or unauthorized access.

3. Fee Schedule & Refund Policy
 
Fees are charged for clerical labour and time, not for "legal results."

3.1 Refund Terms
· Confirmation: Services are confirmed only upon receipt of payment. Cancellation: Rescheduling requires at least 24 hours’ notice; missed appointments result in a forfeited fee. Refund Policy: Digital products and administrative services are non-refundable.
